Amendments to Part 941 - Adjudicatory Proceedings and Appeals Procedures
Part 941 is amended to conform the regulations governing the investigative and enforcement adjudicatory process to the new Section 94 of the Executive Law, as established by the Ethics Commission Reform Act of 2022. Based on public comment received, the proposed regulation was amended by the Commission. This amended rulemaking became effective on an emergency basis on February 28, 2023 and will be published in the State Register as a Revised Rulemaking/Emergency Adoption on March 15, 2023, with public comment period ending on April 29, 2023

Amends Part 941 - Adjudicatory Proceedings and Appeals Procedures
Part 941 is amended to add a new section 941.3-a relating to the delegation of subpoena and other powers to the Executive Director to facilitate the expeditious and efficient performance of the Commission’s investigative and enforcement duties as set forth in Section 94 of the Executive Law. This regulation became effective on an emergency basis on October 11, 2022 with the latest emergency re-adoption occurring on February 28, 2023. Additionally, the Notice of Emergency Adoption and Proposed Rulemaking was first published in the State Register on October 26, 2022 with the public comment period ending on December 25, 2022.

Amendments to Part 943

Part 943 - Text for Submission to State Register_Training Amendments
Part 943 is amended to conform the regulations with the Ethics Commission Reform Act of 2022 which mandated the Commission develop and administer training courses for Lobbyist and Clients. This regulation became effective on an emergency basis on December 20, 2022. Additionally, the Notice of Emergency Adoption and Proposed Rulemaking was published in the State Register on January 4, 2023 with the public comment period ending on March 5, 2023.
