Late Filing Fee Application

Overview

If you received a Late Fee Billing Notice(s) and are assessed a late filing fee(s) you may apply for a waiver or reduction of the assessed late filing fee by completing:

  • Application for Waiver of Late Filing Fee and
  • Late Fee Waiver Application Affidavit.

All fields must be completed on the Application for Waiver of Late Filing Fee and the Late Fee Waiver Application Affidavit must be signed by the Responsible Party and notarized.

Both the completed Application for Waiver of Late Filing Fee and the Late Fee Waiver Application Affidavit must be emailed, in PDF format, to  [email protected].

*NOTE: The Responsible Party is the individual listed on the organization’s profile.

Applications for Waiver of Late Filing Fees should not be filed until you have received a Late Fee Billing Notice(s) from the Commission. Any applications filed prior to a late fee assessment will be disregarded.

The Commission processes waiver requests as promptly as possible. Inaccurate or incomplete information can cause processing delays, which can result in a rejection or denial of requests.

Technical Failure

If a Lobbyist or Client is unable to file due to a technical issue, they must do the following to avoid a late penalty:

  1. Email  [email protected] before the filing deadline to resolve the technical issue.
    1. If, after contacting the helpdesk the filer cannot file, they must email [email protected] proof of technical failure, no later than close of business on the date of the filing deadline. 
  2. If after business hours on the filing deadline a filing cannot be submitted due to a technical  failure with the Lobbying Application (LA), you must send a screenshot or photograph of the error message you are receiving in LA that shows the time and date of the attempted filing to [email protected].

Under no circumstances will the following be considered a technical failure:

  1. Failure of the Lobbyist or the Client to change its Responsible Party;
  2. The Responsible Party’s inability to retrieve, change or reset its password;
  3. Any technical failure that is reported after the filing deadline; or
  4. A filing that has been saved in LA but was not submitted timely.

Note: If there is a system-wide problem with the Commission’s online Lobbying Application, the Commission will notify all filers if the filing deadline has been extended.

Late Fee Schedule

As a reminder, pursuant to the Lobbying Act, the Commission may assess a penalty of up to $25 per day
that a filing is received late; however, the Commission has previously adopted and generally adheres to the
following schedule for late filing fees.
