Description: The confidentiality afforded guidance and guidance-related communications by Executive Law § 94(7)(b) may be deemed waived by the misleading, inaccurate, or incomplete public disclosure of the nature or substance of the guidance and related communications by the recipient. In such instances, the Commission or Commission staff may release information relating to the guidance request, including but not limited to an unredacted version of the request for guidance and of any guidance provided and any related communications between the requester and the Commission.
